Surface Pixel Rules

A healthy community is a successful community, at Surface Pixel we request your co-operation in building a strong community by following a few basic rules.

1. Encourage and help your fellow artists, provide constructive criticism by being helpful and positive in all feedback.
2. Learn from others, we are all at different stages in our creative journey. Whether you are just starting out or a professional artist, you are always welcome here to learn and grow.
3. Art is very emotional for many artists, it takes strength to publicly show those visual emotions to a community. Respect an artist’s rights to express their feelings without the fear of being ridiculed.
4. Do not be hateful, racist, manipulative, demeaning, bigot, rude or any other negative type of person.
5. Be awesome to each other, it’s that simple.

By registering with Surface Pixel, you agree to these guidelines and policies.

1. Politics or political propaganda are often part of art, be respectful and limit this type of work within the application or discussions regarding these topics.
2. Potentially inflammatory discussions or comments regarding social issues
3. These include, but are not limited to, topics such as racism, sexism, religion, xenophobia or homosexuality.
4. Crude, derogatory, inappropriate, or disrespectful remarks aimed at any individual(s)
5. Derogatory, anti-social or inflammatory remarks aimed at any group of people, with the intention to incite a mass response are not only a crime in most countries, but are also totally unacceptable here.
6. Pornography and Excessive Brutality
7. This excludes the tasteful use of nudity in artwork. Images or animations depicting blatantly pornographic acts including intercourse, masturbation, bestiality or abuse, and links to pornographic sites are not tolerated under any circumstances.
8. Unnecessarily violent, crude, or obscene imagery
9. Scenes depicting themes such as rape, or any other brutality will not be tolerated in any form.
10. Racial slurs
11. Spamming
12. Surface Pixel does not tolerate any members that, in any way, aid or encourage the use of illegally acquired software.

Trademarks

All brand, product and service names used in this Service which identify Surface Pixel or third parties and their products and services are proprietary marks of Surface Pixel and/or the relevant third parties.

Use of a trademark not owned or have permission to use is not tolerated, usernames infringing on such trademark/s may be forced to hand over username to rightful owner.

Copyright

Surface Pixel is, unless otherwise stated, the owner of all copyright and data rights in the Service and its contents. Individuals who have posted works to Surface Pixel are either the copyright owners of the component parts of that work or are posting the work under license from a copyright owner or his or her agent or otherwise as permitted by law. You may not reproduce, distribute, publicly display or perform, or prepare derivative works based on any of the Content including any such works without the express, written consent of Surface Pixel or the appropriate owner of copyright in such works. Surface Pixel does not claim ownership rights in your works or other materials posted by you. You agree not to alter or modify any part of the Service unless expressly permitted to do so by us or by use of functions on the Service provided by us.

Our primary needs in collecting information are to provide and improve our Services, to administer your use of the Services (including your Account if you are an Account holder), and to enable you to enjoy and easily navigate our Services.

Textures: You May...

Alter, modify, combine and manipulate the Images as needed. Print the images and distribute the images in printed form in any manner for any purpose. Publish the images in an electronic or digital form as part of a work that is an advertisement, promotion, brochure, report, e-book, e-magazine, web site, game, software, video or editorial article. Provide the images in digital form to another company solely for the purpose of printing the images or creating film separations.

You may upload your own textures to Surface Pixel for all registered users to download and use within their projects. You have the right to remove your uploaded textures at any time if you choose to no longer provide them for others to use.

Textures: You May NOT...

Use these textures depicting people in a manner that is libelous, scandalous, misleading, unlawful or associated with pornography. Incorporate any of the images into a trademark. Use the images in such a way that they imply an endorsement by Surface Pixel or its Suppliers of any product or service. Distribute the images in a manner intended to be separable from the work. Place the images, or allow them to be placed, on an electronic bulletin board or ftp server. Sub-license, sell, re-sell, distribute, give away, lend, rent, lease or provide others with any of the images except as part of a work, unless specifically allowed permission by Surface Pixel. Include the images or derivatives of the images in any clip art or digital image collection or library provided or available to any persons other than the licensed users of the images.

Disclaimer of Warranty and Limitation of Liability

SURFACE PIXEL MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED AS TO THE OPERATION OF THE SERVICE, OR THE CONTENT OR PRODUCTS, PROVIDED THROUGH THE SERVICE. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. SURFACE PIXEL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. SURFACE PIXEL MAKES NO WARRANTY AS TO THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THIS SERVICE. YOU SPECIFICALLY ACKNOWLEDGE THAT SURFACE PIXEL IS NOT LIABLE FOR YOUR DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT, OR SUCH CONDUCT BY THIRD PARTIES, AND YOU EXPRESSLY ASSUME ALL RISKS AND RESPONSIBILITY FOR DAMAGES AND LOSSES ARISING FROM SUCH CONDUCT. Amendment of the Terms

We reserve the right to amend these Terms from time to time in our sole discretion. If you have registered as a member, we shall notify you of any material changes to these Terms (and the effective date of such changes) by sending an email to the address you have provided to Surface Pixel. If you continue to use the Service after the effective date of the revised Terms, you will be deemed to have accepted those changes. If you do not agree to the revised Terms, your sole remedy shall be to discontinue using the Service.

Surface Pixel reserves the right to remove, edit, move or close any account, project, or artwork with or without reason or notice. Polite enquiries are encouraged and will be listened to. Any form of harassment will not be tolerated and is cause for instant banishment.
